Terms of Sale

1. Purpose

These terms of sale govern purchases of Shards packs and subscriptions offered on midnightmind.app and in Midnight Mind applications.

3. Digital products

Shards are virtual currency used to generate visual content (dream comics, Dioramas, etc.) within the app.

12. Right of withdrawal and refunds

12.1 Scope

These terms apply to purchases made directly on midnightmind.app (web channel, payment via Stripe). For purchases made through the iOS and Android mobile apps, Apple App Store and Google Play refund policies apply exclusively.

12.2 Withdrawal period

In accordance with French law applicable to all web transactions regardless of the user's country of residence (under Article 13 of these terms), the user has fourteen (14) calendar days from the date of purchase to exercise their right of withdrawal.

12.3 Waiver for immediately supplied digital content

In accordance with applicable consumer law, the user may expressly waive their right of withdrawal at payment by checking the dedicated box. This waiver applies only to Shards actually consumed.

12.4 Refund terms

If a withdrawal request is made within the 14-day period:

• If no Shards from the purchase have been consumed: full refund of the amount paid.
• If some Shards have been consumed: pro-rata refund for unconsumed Shards. The remaining balance will be debited from the user's account. Example: a Star pack of 150 Shards purchased for €12.90, with 40 Shards consumed, will result in a refund of €9.46 (for the 110 unconsumed Shards) and a debit of those 110 Shards from the user's balance.
• If all Shards have been consumed: no refund can be made.

12.5 Procedure

Any withdrawal request must be sent by email to [email protected] within 14 days of purchase, stating the transaction reference. Refunds will be processed within 14 business days via the original payment method.
